A. Payment Of Expenses Of Towing And Impounding: The registered owner of or person abandoning, parking or otherwise keeping a vehicle in violation of the provisions of this chapter, which is towed and impounded under the provisions of this chapter shall be responsible for those fees and expenses of towing and impounding of the vehicle, which must be paid before the release of the vehicle. The village hereby reserves the right to bring an action at law against said violator, to collect fees or other charges assessed under this chapter which are owed to the village. This fee shall be in addition to a fine provided for herein for any violation of this chapter.
B. Requirements For Release: The registered owner of a vehicle towed pursuant to this chapter may secure the release of the vehicle by furnishing evidence of his or her identity and ownership or possessory right to the vehicle, by signing a receipt for the vehicle, and by paying or causing to be paid to the village and/or the towing and impoundment service operator the following fine and fees:
1. Fine: The fine imposed pursuant to section 7-9-13 of this chapter.
2. Towing And Impoundment Fees: The towing and impoundment fees charged by the towing and impoundment service operator.
C. Release Of Invalidation Of Tow: Notwithstanding any other provision of this chapter to the contrary, the registered owner of a towed vehicle may remove the vehicle without paying any fine or fee otherwise required to be paid pursuant to this chapter if the police chief determines, on appeal or otherwise, that the tow of the vehicle was not authorized pursuant to this chapter or was otherwise invalid.
D. Taking Possession: The registered owner shall take possession of the towed vehicle no later than twenty four (24) hours after satisfaction of the requirements for release set forth above.
E. Hearing Request: After release of a towed vehicle pursuant to this section, the registered owner of the vehicle in question may subsequently appeal the tow and request a hearing pursuant to section 7-9-8 of this chapter. (Ord. 00-2156, 12-18-2000)
